ENDORSEMENT

The application by the Ontario Human Rights Commission for judicial review of Order P-363 made by Assistant Commissioner Mitchinson is dismissed.

In a number of recent decisions, the Divisional Court has fully convassed the appropriate standard of review to be applied to the Commissioner of Information and Privacy. We are satisfied that Mr. Mitchinson's Interpretation and application of ss.13(1) and 14(2)(a) of the Freedom of Information and Protection Act is amply supported by the legislation on the facts In this case.

If counsel are unable to agree on the matter of costs, the court may be spoken to.
