J.R. of P-312
Court File No: 481/92

ONTARIO COURT (GENERAL DIVISION)
DIVISIONAL COURT

Carruthers, Dunnett and Adams JJ.

MINISTER OF GOVERNMENT SERVICES

and

Tom Mitchinson, Assistant Information and Privacy Commissioner et al.

ENDORSEMENT

The application is dismissed.

The Commissioner's decision ought to be accorded a strong measure of curial deference (John Doe v. Ontario (Information and Privacy Commissioner) (1993), 13 O.R. (3d) 767).

The Commissioner in our view gave the relevant statutory provisions an interpretation they can reasonably bear. The Court is not prepared to substitute its opinion in the absence of there being no evidence. We find that there is no jurisdictional error.

No costs.
