ENDORSEMENT

The application is dismissed. We are satisfied that the presumption contained in section 14(3) (b) applies. The exception therein, in our view, does not relate to possible proceedings against the interested parties. Section 14(4) is not applicable.

The Commissioner made no legal error and it is not our role to substitute our judgment on the merits for the decision made by him.

The application is dismissed. No costs.
