- A relevant factor in determining whether information received by an institution from another government was received in confidence is whether the information is subject to exemptions in the provincial Freedom of Information and Protection of Privacy Act. Where such exemptions apply, they may form a reasonable basis for an expectation of confidentiality in the records (Order # MO-1327).
